Little Swaps Terms and Conditions

Welcome to Little Swaps! By accessing or using our mobile application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully, as they govern your use of our services-including buying, selling, and coordinating exchanges of kids’ items through features such as Swap Spots and our in-app messenger. If you do not agree with these Terms, please refrain from using the App.

1. Introduction
   Little Swaps (“we,” “us,” “our”) provides a trusted marketplace that allows registered users (“you,” “your,” “users”) to buy and sell new and secondhand kids’ items such as clothing, toys, and furniture. We are based in New York and operate through our mobile application nationwide.

2. Eligibility
   Users must be at least 18 years old to create an account and use Little Swaps. By using our App, you represent that you meet this age requirement, have the legal authority to enter into this agreement, and will comply with all applicable laws and these Terms. You are responsible for all activity that occurs under your account.

3. Account Creation & Management

• To use the App, you must create an account and provide accurate, complete, and current information.

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. If you suspect unauthorized use, notify us immediately at support@littleswaps.com.

• Users are responsible for the legality, accuracy, and quality of their listings and for complying with applicable laws and product safety regulations.

4. Prohibited Conduct
   You agree not to use the App for any unlawful or fraudulent purpose, misrepresent items for sale, engage in harassment, attempt to access another user's account, or circumvent platform fees or security systems. Violation of these Terms may result in suspension or termination of your account.

• Use the platform for unlawful purposes or post any illegal, fraudulent, or misleading content.

• Misrepresent items for sale or infringe upon others' rights, including intellectual property rights.

• Engage in disruptive or abusive behavior, including spamming, harassment, or posting offensive content.

• Attempt to access another user's account or interfere with the platform’s security.4

  4. 1 In-App Messenger

  The in-app messenger allows communication about listings, deliveries, or meetups. Users may not send offensive or inappropriate content or share private payment details. Messages may be monitored for safety or fraud prevention but will not be shared publicly unless required by law.
  

5. Listing Guidelines & Item Standards
   To maintain quality and safety, please adhere to the following guidelines:

• Condition: Items must be in gently used, like-new, or new condition—no stains, rips, heavy wear, missing parts, or damage. Everything should be clean and ready for another family to love.

  • New With Tags: Your item has never been worn and the original hanging tags are still on. For this option, you’ll need to take pictures of the retail tags."

  • Like New: Your item has never been worn (other than perhaps trying it on), but the tags have been removed. There are no quirks or issues whatsoever.

  • Used - In good condition: Your item has only been lightly used and has been extremely well maintained. There may be some small signs of wear, but nothing major.

  • Used - But Plenty Of Life Left: Item shows noticeable signs of wear but despite its imperfections, it remains functional and wearable, offering substantial use to its next owner. All flaws should be clearly described and photographed to ensure transparency.

• Quality: We do not accept fast fashion or low-quality items that don’t last. This includes brands like Shein, Temu, and similar ultra-fast fashion labels. Some retailers, like Target, sell both well-made and low-quality items—only durable, high-quality pieces should be listed.

• Safety: Items that contain harmful chemicals, recalled products, or anything known to be toxic for children are prohibited. Parents are responsible for checking product safety before listing. For more details, visit the Consumer Product Safety Commission (CPSC) website.

• Toys & Gear: We accept toys, baby gear, and other children’s essentials—as long as they are in great condition and fully functional. All pieces must be included, and items must meet safety standards. Recalled items are not permitted.

• Listing Details: All listings must include clear, accurate photos and descriptions. Everything must be clean and in good shape—no heavily worn or damaged items. Pricing should reflect quality and condition (New with tags, Like New, Used in good condition, Used but plenty of life left).

• Seasonal Items: You can list items year-round, no matter the season. If it’s in great condition, it’s welcome on Little Swaps!

6. Buying & Selling

• Listings: Users can post items for sale with a clear description, condition, and price. Items must be accurately represented.

• Purchases: When purchasing an item, buyers agree to pay the listed price and any applicable fees. Payments are made through the platform’s secure payment processor.

  • 6.1 Delivery Options:

  • Sellers can choose one of three delivery methods: Swap Spot Drop-Off, In-Person Meetup, or Shipping. Buyers select their preferred option at checkout based on seller availability.

  • 6.2 Swap Spots

    Swap Spots are pre-approved local shops for safe drop-offs and pickups. Sellers label items clearly, scan the Swap Spot Location QR code when dropping off, and buyers scan the same QR code when picking up. Little Swaps is not responsible for lost, damaged, or unclaimed items but may assist in investigations. If packages are not delivered in 3 or less business days the transaction will be cancelled. If packages are not picked-up in 3 or less business days the package will be donated and money won’t be refunded.

    Swap Spots are independent, pre-approved local businesses that serve as secure hand-off points for item drop-offs and pickups arranged through the Little Swaps platform.

    1. Process
        a. Sellers must clearly label each package with the buyer’s name and order number and location before bringing their item to the bin in the Swap spot..
        b. At drop-off, the Seller must open the order sold and, within the app, scan the Swap Spot location QR code to confirm delivery.
        c. Buyers must open their app order and scan the same QR code upon pickup to confirm receipt of the item. Only then, the seller will be released the funds of the purchase.

    2. Responsibility
        Little Swaps does not own, operate, or control any Swap Spot location. Swap Spots act solely as neutral delivery points. Little Swaps is not responsible for any lost, stolen, damaged, or unclaimed items but may, at its sole discretion, assist in facilitating an investigation or resolution between Buyer, Seller, and Swap Spot.

    3. Delivery & Pickup Deadlines
        a. Sellers must deliver packages to the designated Swap Spot within three (3) business days of order confirmation.
        b. Buyers must pick up their packages within three (3) business days of receiving notice of availability.
        c. Transactions not fulfilled within these timeframes may be automatically cancelled.

    4. Unclaimed or Abandoned Packages
        Packages not collected by the Buyer within the pickup period may be considered abandoned. Abandoned packages may be donated, recycled, or otherwise disposed of at Little Swaps’ discretion. In such cases, no refund or reimbursement will be issued to either party.

    5. Liability Limitation
        Participation in the Swap Spot program is voluntary and at the user’s own risk. Neither Little Swaps nor its Swap Spot partners shall be liable for any indirect, incidental, consequential, or punitive damages arising from or related to use of a Swap Spot.

    6. Program Changes
        Little Swaps reserves the right to modify, suspend, or discontinue the Swap Spot program, or any of its terms, at any time without prior notice.

    7. 6.2 In-Person Meetups

    8. If users agree to meet in person, payment occurs directly between buyer and seller. Little Swaps does not handle or charge fees for these transactions and is not liable for any incidents, disputes, or losses.

    9. 6.4 Shipping

       • Sellers are required to ship items within 3 days of purchase and buyers should review shipping terms provided by sellers.

       • If a seller fails to ship within this timeframe, buyers may cancel the order and receive a full refund by contacting support@littleswaps.com. If no cancellation request is made, the order will remain active.

       6.5 Disputes & Returns

    10. Users should attempt to resolve disagreements directly through the in-app messenger. Little Swaps may review cases involving fraud or misrepresentation but is not obligated to mediate disputes.

7. Fees and Payment Terms

• Transaction Fees: We may charge a transaction fee or commission for each sale, which will be communicated to users in advance.

• Refunds: Transaction fees are non-refundable unless otherwise specified by us. Refunds for item purchases are subject to seller policies and the outcome of any dispute resolution.

8. Content Ownership and License

• User Content: Users retain ownership of content they post on the platform but grant Little Swaps a non-exclusive, royalty-free license to use, display, and share this content as necessary for platform operation.

• Intellectual Property: All intellectual property within the app is owned by Little Swaps or its licensors. Users are prohibited from copying, modifying, or using our intellectual property without permission.

9. Liability Limitation & Safety Disclaimer
   To the fullest extent permitted by law, Little Swaps is not liable for any damages arising from user interactions, the sale or purchase of items, or the quality of items listed. We are not responsible for ensuring the accuracy, legality, or safety of items posted by users.

   Always meet in public, well-lit areas. Do not share phone numbers, personal addresses or financial details outside the app. Little Swaps does not perform background checks and is not responsible for accidents, theft, or damages during meetups or Swap Spot exchanges. You are solely responsible for your safety and conduct during transactions.

10. Termination & Suspension

• Account Suspension or Termination: We reserve the right to suspend or terminate accounts that violate these Terms, misuse the platform, or harm the community.

• User-Initiated Termination: Users may request account termination at any time by contacting support.

• Upon termination, user access to account information, past transactions, and listings may be restricted.

11. Governing Law and Dispute Resolution

• Governing Law: These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles.

• Dispute Resolution: Users agree to first attempt to resolve any issues with Little Swaps through our customer support. If unresolved, disputes will be subject to the exclusive jurisdiction of the state and federal courts located in New York.

12. Content Ownership and License

    You retain ownership of your posted content but grant Little Swaps a non-exclusive, royalty-free license to use it for platform operation and promotion. All app features and branding are owned by Little Swaps or its licensors.

13. Modifications to Terms
    We may update these Terms from time to time. Changes will be effective upon posting, and continued use of the platform constitutes acceptance of the updated Terms.
